Los Angeles Judge Dismisses Marilyn Manson Sexual Assault and Battery Case Filed by Former Assistant
A Los Angeles judge has dismissed the sexual assault and battery lawsuit filed against Marilyn Manson, whose real name is Brian Warner, by his former personal assistant, Ashley Walters. The trial, originally set to begin in early 2025, will no longer proceed.
Los Angeles County Judge Steve Cochran explained the decision, noting that “the complaint was not filed until about 10 years after the events occurred,” and he could not apply the “delayed discovery rule” in this instance. The rule typically pauses the statute of limitations when a plaintiff could not reasonably have discovered an injury or harm sooner.
Walters’ attorney, Kate McFarlane, expressed disappointment with the ruling, telling Rolling Stone, “We believe this decision is wrong. The delayed discovery rule exists to allow sexual abuse victims the opportunity to seek justice, even when abusers have used tactics to prevent them from coming forward. This happens too often, and the law hasn’t fully caught up to what’s fair for survivors. But this isn’t necessarily the end.”
Manson’s lawyer, Howard King, also issued a statement: “It’s gratifying that a judge reviewed the facts and found Brian Warner was wrongly accused. While it came at great personal cost, he can now move forward.”
Walters first filed her lawsuit in 2021, claiming she endured “horrific” abuse while working as Manson’s assistant from 2010 to 2011. The case was dismissed in May 2022 but revived in December 2024 after an appeal.
Manson has faced additional allegations, including rape and torture claims from his ex-fiancée, Westworld star Evan Rachel Wood, and accusations of abuse from Game of Thrones actress Esmé Bianco. Bianco filed a lawsuit in 2021 citing sexual, physical, and emotional abuse, which was settled out of court in January 2023. In September 2023, Manson reached a private settlement with another woman who alleged he raped her in 2011, claiming he threatened her and denied basic needs during their relationship.
Both Manson and his legal team have denied all allegations. In January 2025, the Los Angeles County Sheriff’s Department concluded a four-year investigation, stating there was insufficient evidence to charge Manson with sexual assault and citing the statute of limitations as a factor.
Evan Rachel Wood reflected on the outcome, stating, “My lawyer and I were advised by law enforcement that there was compelling evidence to support our claims, but the statute of limitations prevents many crimes from being prosecuted. Evidence of violent crimes should not have an expiration date. I am proud of all the survivors who risked everything to protect others by speaking the truth.”
